The crypto market has gained access to mortgage credit in the United States through administrative action, rather than market validation. This development is considered significant, especially since it allows loans collateralized by Bitcoin and stablecoins within Fannie Mae's perimeter.
However, experts caution that this authorization was issued without an approved statutory framework and with a legislative bill still in its introductory stage. As such, the sector has not actually gained access to the mortgage market but rather an operating window subject to review.
This distinction is crucial because it highlights the regulatory risks associated with crypto-backed loans. The directive can be revoked, the bill can be shelved, and congressional composition can change, all of which are beyond the sector's control.
The use of collateral in these loans does not resolve credit risk but rather relocates it. A mortgage loan depends on a borrower's ability to generate income for 30 years, and guaranteeing the loan reduces loss given default but does not reduce the probability of default.
