Crypto Sector Gains from CLARITY Act Failure
A recent analysis by Bitwise Asset Management has identified four areas of the crypto sector that benefited from the failure of the CLARITY Act in the US Senate. The bill, which aimed to regulate the industry, was voted down on September 15, and its failure has created advantages for these sectors. One of the main beneficiaries is the stablecoin sector, where platforms have retained the ability to offer customers rewards on their balances. This is due to the fact that the bill's proposed restrictions would have penalized issuers up to $5 million per violation.
According to Matt Hougan, chief investment officer at Bitwise, the failure of the CLARITY Act has given the crypto industry 'better rules, faster'. The stablecoin sector has also gained from the fact that traditional banks have resisted the regulation, which is likely to help stablecoins gain share from the traditional system. Coinbase, a major crypto exchange, has defended stablecoin rewards against bank-style regulation and is likely to benefit from the failure of the bill.
Other areas that have gained from the failure of the CLARITY Act include crypto exchanges, which have retained licensing and brokerage advantages. This means that established trading operators can continue to operate under the existing state licensing system, rather than being subject to a national licensing framework. Tokenization platforms have also gained from the exemption of tokenized stock trading, which allows qualifying venues to use permissioned automated market makers and liquidity pools.
Finally, token buybacks have received guidance with conditions, which means that revenue-generating tokens can continue to repurchase supply without being subject to securities regulations. However, there is still a risk that an administration taking office in January 2029 could appoint regulators who adopt a harder line on the industry.
