Heinrich Blocks Bipartisan Bill to Shield Consumers from Data Center Energy Costs

A bipartisan bill aimed at shielding consumers from data center energy costs has hit a roadblock in the Senate, thanks to Senator Martin Heinrich of New Mexico. The Ratepayer Protection Act, championed by Senator Jon Husted of Ohio, would require large-load electricity customers drawing 100 megawatts or more to cover the full incremental costs of grid and generation upgrades their operations trigger.

Senator Heinrich objected to the bill, calling its framework 'voluntary' and insufficient for real consumer protection. He argued that without binding federal enforcement, the cost-shifting problem continues under a politely worded new label.

In contrast, Senator Heinrich's own GRID Savings Act would empower the Federal Energy Regulatory Commission to impose mandatory cost-responsibility rules on electricity users exceeding 150 MW. This bill also establishes reliability safeguards and incentivizes hyperscale facilities to invest in higher-voltage transmission infrastructure.
