ICBA Sues OCC Over National Trust Bank Charters for Crypto Firms
The Independent Community Bankers of America (ICBA) has sued the Office of the Comptroller of the Currency (OCC) in a bid to block the granting of national trust bank charters to cryptocurrency firms.
According to ICBA, Congress did not intend for the OCC's national trust charter to serve as a 'side door' into the banking system for crypto companies seeking federal credibility without the usual regulatory requirements.
The lawsuit argues that the OCC's decision allows these firms to enter the U.S. banking system without being subject to the same level of oversight faced by community banks, creating a severe competitive disadvantage.
ICBA is also concerned about consumer risk, stating that digital assets held at crypto firms operating under national trust charters do not carry the same safeguards as those in traditional banks.
