Illinois Agrees to Delay Digital Asset Tax Amid Industry Pushback

Illinois officials have agreed to a six-month delay in implementing the state's controversial Digital Asset Tax, joining crypto industry groups in seeking a postponement from January 1 to July 1, 2027. The joint filing, made on October 1, 2026, in Sangamon County, comes amid ongoing litigation and rulemaking processes. Revenue Director David Harris and Attorney General Kwame Raoul supported the delay despite continuing to defend the law's constitutionality.

The 0.2% levy, enacted in June 2026, targets the value of digital assets in covered transactions rather than trading profits. The tax imposes collection duties on brokers, who remain liable if they fail to collect it. Customers also face a fallback obligation to pay the tax themselves if not charged by the broker.

The delay, if approved, would give crypto firms more time to adapt to the new regime, which could otherwise raise compliance costs and push activity out of Illinois. The court had not confirmed entry of the order as of October 4, 2026. Public comments on the preliminary rules remain open through October 30, 2026.

Both sides have asked to extend the state's deadline for responding to the lawsuit to November 13, 2026. The legal challenge and rulemaking process will continue, leaving the ultimate validity of the tax regime uncertain even with the delay.
