JPMorgan Warns Crypto Regulation Lacks Long-Term Sustainability Amid Clarity Act Setback
JPMorgan analysts have raised concerns about the long-term sustainability of crypto regulation led by the SEC and CFTC. According to their report, rulemaking by these regulators could be reversed by the next administration, making it challenging for the industry to secure statutory regulatory clarity.
The Clarity Act, which aimed to provide a clear framework for cryptocurrency regulation, failed in a Senate procedural vote. Although the congressional session has not ended, the probability of the bill passing before year-end fell to about 6.6% after the failed vote.
JPMorgan analysts suggest that while the SEC and CFTC can use their own rulemaking to fill regulatory gaps, these steps could be rolled back by future administrations, creating uncertainty for the industry.
