Peirce Optimistic on CLARITY Act Passage Ahead of Crucial Senate Deadline
SEC Commissioner Peirce has provided an update on the CLARITY Act, which aims to clarify regulatory jurisdiction over the crypto spot market. She expressed optimism that the bill will pass and give 'the industry and investors and regulators an easier path forward.' The legislation would establish clear lines about who has authority over the market.
The CLARITY Act draws a distinction between digital assets classified as commodities and those classified as securities, assigning regulatory jurisdiction to either the SEC or the CFTC depending on the asset. For XRP, which has established regulatory clarity following its legal battle with the SEC, a clear statutory framework could reinforce its position and expand the legal certainty institutional investors need.
The Senate has 51 confirmed votes for the bill but needs 60 to clear the filibuster. The Senate departs for recess on August 8, and it's unclear if the bill will be scheduled for a floor vote before then. However, Peirce echoed SEC Chair Paul Atkins' statement that the agency is ready, willing, and able to make rules.
