Poland's MiCA Implementation Changes Regulatory Landscape for Crypto Businesses

Poland is becoming an increasingly attractive jurisdiction for companies looking to enter the European cryptocurrency market. However, the country's regulatory environment has undergone significant changes with the implementation of the Markets in Crypto-Assets (MiCA) regulation.

Before MiCA came into effect, crypto businesses in Poland operated under a relatively limited national framework focused on anti-money laundering obligations. Registration in the Polish virtual currency activity register was not equivalent to a full financial services license or prudential authorization.

The introduction of MiCA has fundamentally changed this situation, introducing a common framework for crypto-asset service providers across the EU. This includes activities such as custody, operation of trading platforms, exchange of crypto-assets, and portfolio management.

For businesses planning to operate in Poland, understanding this transition is crucial. The old Polish register should not be confused with MiCA authorization, which requires a more comprehensive approach to licensing.
