SEC and CFTC Fill Regulatory Vacuum Left by Failed Crypto Bill
The US crypto regulatory landscape has seen significant developments in recent days following the Senate's failure to pass the CLARITY Act. The bill, which aimed to establish a clear jurisdictional framework for digital assets, was killed by a procedural vote on September 15. However, the SEC and CFTC have since stepped in with agency actions that may provide temporary relief for crypto firms and tokenization platforms.
The SEC granted a five-year conditional 'innovation exemption' on September 17-18, allowing regulated venues to trade tokenized NMS stocks through automated market makers without full exchange or dealer registration. Meanwhile, the CFTC broadened its staff no-action relief for passive software providers that help users access regulated derivatives markets.
A key concern raised by TD Cowen's Washington Research Group is that these agency actions are less durable than legislation and can be easily rescinded by a new commission chair or a shift in the political composition of the commission. This highlights the need for clear, statutory law to provide long-term regulatory certainty.
