SEC Confirms Ethereum Staking Doesn't Create Securities, But Guidance Can Be Rescinded
Yesterday, the SEC clarified Ethereum staking rules, confirming it doesn't create securities. However, this guidance can be rescinded without a formal Commission vote.
1.68 million ETH is currently in queue at an 11-to-1 entry-to-exit ratio, meaning new stakers will face roughly a one-month wait before earning rewards.
Ethereum spot ETFs attracted $690 million between September 21 and 25, but daily investments declined from $270 million to $87 million.
The SEC's guidance establishes clearer rules for Ethereum staking, but it does not guarantee long-term protection. Unless the SEC turns these FAQs into formal rules or Congress passes a new bill, that certainty may be temporary and subject to change as the regulatory landscape shifts.
