A funding lapse in Congress has put a freeze on the review of new cryptocurrency exchange-traded fund (ETF) applications by the U.S. Securities and Exchange Commission (SEC). As of early October 2026, the agency's contingency plan limits staff to essential duties, halting reviews of pending ETF filings.
This means that issuers awaiting decisions will experience an information gap, as deadlines tied to review periods are effectively tolled. The SEC cannot issue approval orders or advance any application through the standard review pipeline until funding is restored.
The agency's Division of Investment Management and its trading and markets staff normally manage ETF reviews under defined statutory windows, but a funding lapse can interrupt these windows even when underlying analysis work is complete.
