SEC Exempts Meme Coins from Federal Oversight

Share

The US Securities and Exchange Commission (SEC) has ruled that meme coins are not securities under federal law, exempting them from strict financial regulations. This decision classifies meme tokens as 'collectibles' instead.

In its announcement, the SEC emphasized that meme coins have limited or no use, primarily serving entertainment, social interaction, and cultural purposes. Their value stems from market demand and speculation rather than underlying business performance.

The ruling means transactions involving meme tokens are not subject to registration under the Securities Act of 1933, exempting creators and traders from disclosure requirements and other federal securities laws.

Financial analysts noted that this decision marks a departure from the SEC's generally cautious approach toward cryptocurrency regulation. Rep. Sam Liccardo has introduced legislation aimed at restricting government officials from issuing digital tokens, citing concerns about transparency, insider trading, and improper foreign influence.
