SEC Pledges Continued Rulemaking Efforts Despite Senate Setback on Digital Asset Legislation

Securities and Exchange Commission Chairman Paul Atkins stated that his agency will continue to push for its own crypto rulemaking agenda despite the Senate's failure to advance legislation on a federal framework for digital assets.

The CLARITY Act, which aimed to establish a framework for digital assets, stalled in the Senate with a procedural vote falling short at 49 to 50. The bill required a 60-vote threshold to move forward and remains gridlocked over disputes on ethics provisions and stablecoin rules.

Atkins emphasized that the SEC will proceed with its own rulemaking efforts, citing a three-part framework: custody rules allowing self-custody for investment advisers under certain conditions; Regulation Crypto Assets, which proposes rules for crypto investment contract offerings; and transfer-agent modernization to address electronic communications, recordkeeping, and blockchain technology.

Atkins also reiterated that the agency will act 'decisively' within its existing legal authority. The SEC's focus is on creating a workable regulatory perimeter for digital assets through its own authority rather than waiting for legislative solutions.
