South Korea Proposes Rules for Seizing Crypto Assets from Debtors

The South Korean government is proposing new rules to allow creditors to seize and liquidate cryptocurrency assets held by debtors. The Supreme Court has submitted amendments to the Civil Execution Rules, which would give creditors a standardized process for freezing, identifying, and liquidating debtor crypto holdings.

Under the proposed rules, cryptocurrency exchanges will have only seven days to disclose customer holdings if they are served with a court order. The new rules could take effect as early as October 1, giving exchanges a seven-week window to prepare.

The proposed amendments aim to create a more streamlined process for creditors to recover debts from debtors who hold cryptocurrency assets. This includes the ability to freeze debtor access to assets held with custodians and prohibit custodians from transferring frozen assets.

In addition, the new rules will require custodians to disclose holdings within one week of being served with a court order. The process could have far-reaching implications for South Korea's retail-heavy cryptocurrency market, which has seen significant growth in recent years.
