Tribal Partnerships Complicate Kalshi's Event Contract Business

The Tunica-Biloxi Tribe of Louisiana has partnered with Kalshi to launch a prediction market app, despite controversy surrounding Kalshi's event contracts.

Kalshi offers regulated event contracts, but its relationship with tribal gaming has been strained. The company is currently embroiled in multiple legal challenges from tribes arguing that its sports event contracts violate the Indian Gaming Regulatory Act (IGRA), a federal law protecting tribal sovereignty over gaming operations.

The Tunica-Biloxi Tribe operates Paragon Casino Resort, one of Louisiana's prominent gaming destinations. The tribe has been diversifying beyond casino floors, with a memorandum of understanding set for 2025 with Louisiana State University Alexandria signaling interest in education and broader economic development partnerships.

The IGRA established three classes of gaming and required tribal-state compacts for the most lucrative categories. Kalshi is regulated by the Commodity Futures Trading Commission (CFTC) as an exchange offering event contracts, but tribes view certain event contracts as functionally identical to sports betting.
