XRP Secures Regulatory Clarity Ahead of CLARITY Act Passage
Ripple's Chief Legal Officer Stuart Alderoty has stated that XRP has already secured regulatory clarity, independent of whether Congress passes the CLARITY Act. This certainty came through two separate paths: the outcome of Ripple's own SEC lawsuit and joint SEC-CFTC guidance confirming XRP and other digital assets qualify as commodities.
Alderoty noted that this clarity didn't come easily, with many in the industry initially dismissing Ripple's efforts to fight the SEC on behalf of crypto broadly. However, sentiment has since shifted, with more of the industry recognizing Ripple's role in shaping the legal landscape.
The SEC's newly proposed 400-page 'Regulation Crypto Assets' guidance cites Ripple's comment letters directly and reflects several legal positions the company argued during its lawsuit. Alderoty argued that regulators shouldn't wait for Congress to act, as their job is to work within existing laws to protect consumers and market integrity.
According to Alderoty, if the CLARITY Act does eventually pass, the SEC and CFTC would simply adjust their existing rules to align with it, rather than starting from scratch. This means that XRP's regulatory status, hard-won through years of litigation, isn't riding on the outcome.
