RBC Hit with $1.9M Damages after Wrongful Termination of Financial Adviser

A recent court ruling in Canada has left employers with a warning sign after a financial institution was ordered to pay $1,919,000 in damages for wrongfully terminating a financial adviser.

The case involved a former Royal Bank of Canada (RBC) employee who was fired and reported to the regulator for allegedly sending confidential information to their personal email and processing transactions without authorization.

However, Justice Annette Casullo found that RBC's allegations did not withstand judicial scrutiny and that the investigation had serious deficiencies. The court ruled that the employee, Silva, had no reasonable prospect of employment in financial planning while the regulatory allegations remained outstanding and awarded damages for loss of earning capacity.

The ruling is significant as it highlights the importance of employers conducting thorough investigations before making decisions about terminating employees, particularly those in professions where reputation and licensure are crucial.
