NCLT Rejects Jet Airways' Plea for ₹500 Crore Refund from Boeing

The National Company Law Tribunal (NCLT) has dismissed Jet Airways' plea for a refund of ₹500 crore from Boeing, citing a contractual dispute over advance payments. The tribunal observed that the matter involves complex questions of fact and law that require a full trial.

Jet Airways had entered into agreements with Boeing in 2013 to purchase two aircraft, but Boeing suspended the deals in May 2019 due to payment delays. After Jet Airways went into liquidation in November 2024, the airline's liquidator sought recovery of $92.13 million in advance payments made to Boeing.

Boeing had claimed a total of ₹873.78 crore from Jet Airways, including set-off under Regulation 29 of the IBBI (Liquidation Process) Regulations, 2016. However, the NCLT held that disputed questions of fact and law require evaluation of the underlying agreements, which were not placed on record due to confidentiality issues.
