CFTC Proposes Federal Framework for Leveraged Crypto Exchanges
The U.S. Commodity Futures Trading Commission (CFTC) has introduced new rules aimed at establishing a federal regulatory framework for cryptocurrency exchanges that offer leveraged digital asset trading. The proposal, unveiled on Monday, would allow these exchanges to opt for federal oversight instead of navigating a patchwork of state money-transmitter licenses.
The move comes in the wake of Congress's failure to advance comprehensive crypto regulation in recent weeks. Under the proposed rules, exchanges choosing the federal framework would operate under a single set of regulations rather than complying with varying state requirements. Industry participants have long criticized the current state-by-state approach for creating excessive burdens.
The CFTC's proposal leverages its existing authority to oversee margined or leveraged spot assets. Currently, the spot cryptocurrency markets lack clear regulatory guidelines. While the CFTC has sought authority to regulate these markets, only Congress can grant such power. The proposed rules would introduce a new category of CFTC-regulated trading venues called a "crypto asset market" for exchanges offering leveraged or margined trading to retail customers.
