CFTC Unveils Federal Framework for Crypto Exchanges
The U.S. Commodity Futures Trading Commission (CFTC) has introduced new rules aimed at establishing a federal regulatory framework for cryptocurrency exchanges that provide leveraged digital asset trading. This proposal allows U.S. crypto exchanges to opt for federal oversight rather than relying on state money-transmitter licenses, a move that comes after Congress failed to pass comprehensive crypto regulations.
The new framework would enable exchanges to follow a unified set of federal rules instead of navigating varying state requirements. Industry participants have long argued that the current state-by-state approach imposes unnecessary burdens.
The proposed rules leverage the CFTC’s existing authority to regulate margined or leveraged spot assets, which currently lack clear regulatory guidelines. While the CFTC has sought authority to oversee these markets, only Congress can grant such power. The proposed rules would introduce a new category of CFTC-regulated trading venues called a "crypto asset market" for exchanges offering leveraged or margined trading to retail customers.
