Ripple's XRP Secures Regulatory Clarity Regardless of CLARITY Act
Ripple's Chief Legal Officer Stuart Alderoty claims that $XRP has already secured regulatory clarity through two separate paths. First, Ripple's own SEC lawsuit has provided certainty for the asset's status. Second, a joint SEC-CFTC guidance confirmed that several digital assets, including $XRP, qualify as commodities.
Alderoty acknowledges that this clarity didn't come easily and was initially met with skepticism from the rest of the industry. He says that Ripple was public from the start about fighting the SEC on behalf of crypto broadly, but many in the industry dismissed this claim at first.
However, Alderoty points out that sentiment has shifted since, with more of the industry now recognizing Ripple's role in shaping the legal landscape. He cites the SEC's newly proposed 400-page 'Regulation Crypto Assets' guidance as further validation, which directly references Ripple's comment letters and reflects several of their argued legal positions.
Alderoty argues that regulators shouldn't wait for Congress to pass legislation, but rather work within the laws as they currently exist. He believes that if the CLARITY Act does eventually pass, the SEC and CFTC would simply adjust their existing rules to align with it, not start from scratch.
