Google AI Overviews Lawsuit Dismissed Due to Lack of Formal Agreement with Publishers
A lawsuit filed by Penske against Google over its AI Overviews has been dismissed due to lack of evidence that Google entered into any formal agreement with publishers. The court found that there was no 'formal bargain' struck between publishers and Google, which is necessary for a claim under antitrust law.
Penske operates several publications, including Rolling Stone, The Hollywood Reporter, Billboard, and Variety. They claimed that Google's AI Overviews effectively forced them to provide content for free in exchange for visibility in search results. This, they argued, allowed Google to repurpose their content without compensation, reducing the need for users to click through to the original websites.
The court rejected the publishers' reciprocal dealing theory, stating that 'an expectation is not an agreement.' Judge Amit P. Mehta noted that the complaints did not establish any actual agreement or negotiated terms between Google and the publishers.
